EVICTIONS

Eviction is never a desirable outcome, but it is sometimes necessary to protect both owner income and the long-term health of the property. While our goal is always to place qualified tenants and foster positive relationships, payment defaults and lease violations can occur. When they do, we follow a structured, compliant process to protect all parties involved.

Late Fees and Income Distribution

  • Late fees are assessed in accordance with the lease beginning on the 6th day of each month.
  • Late fee income is split 50/50 between the broker and the owner, as outlined in the management agreement.

Default Notices

  • Default notices are issued on the 6th day of each month, or the next business day if the 6th falls on a weekend or holiday.
  • 14-day notices are issued for tenants on fixed-term leases.
  • 30-day notices are issued for month-to-month tenants.

Eviction Process

  • Following the applicable notice period, eviction documentation is submitted to our attorney when warranted.
  • Eviction proceedings are typically withheld if a tenant has paid a substantial portion of the balance due, unless otherwise directed by the owner.
  • All eviction actions are handled in accordance with state and local laws and subject to attorney review.

Attorney and Courthouse Fees

  • Attorney fees and court costs are the responsibility of the owner at the time of filing and are pursued for reimbursement from the tenant when legally permissible.
  • An Eviction Court Fee may be charged per filing as outlined in the management agreement.
